Terms and Conditions

Magic Marketing Entertainment – (B2C) Website: 4seasonsmiracle.com

Article 1 – Definitions
Webshop: 4Seasons Miracle / Magic Marketing Entertainment, located in Breda, registered with the Chamber of Commerce (KvK) under number 73170909.
Customer: The natural person or legal entity that places an order.
Products: Magic tricks, supplies, and instructions.

Article 2 – Applicability
These terms and conditions apply to every offer made by 4Seasons Miracle and to every agreement concluded between the webshop and the customer.

Article 3 – The Offer and Pricing
All prices are stated in Euros, including VAT and excluding shipping costs.
Since magic tricks are often based on a secret or specific instructions, the customer is deemed to understand that the value of the product resides partly in the shared knowledge and secrets provided.

Article 4 – Payment

  • iDEAL | WERO: Secure, direct payment via the WERO interface.

  • Bancontact (Belgium): Secure payment for our Belgian customers.

  • EPS: Electronic payment system for customers from Austria.

  • Credit Card: Support for major international credit card providers.

  • PayPal: Secure payment via your personal PayPal account or credit card.

The order will only be processed once the payment has been received in full.

Article 5 – Delivery
After receipt of payment, we will ship your letterbox package as soon as possible, and you will receive a Track & Trace code.

Article 6 – Right of Withdrawal and Returns

  • Physical Products: The customer has the right to cancel the order within 14 days of receipt without providing a reason, provided that the seal (if applicable) remains unbroken.

  • Exception: As soon as the instructions or the secret of a magic trick have been revealed (for example, by opening a sealed envelope or breaking packaging that provides access to the explanation), the right of withdrawal is voided.

Article 7 – Costs in Case of Withdrawal

  • If the customer exercises their right of withdrawal, the costs of the return shipment shall be borne by the customer.

  • If the customer has made a payment, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This refund will only take place after the product has been received by the webshop in good condition (in accordance with Articles 6 and 11).

  • If the customer chose a more expensive delivery method than the standard delivery (e.g., express shipping), the additional costs for this method will not be refunded.

Article 8 – Confidentiality and Non-Disclosure

  • The customer commits to not disclosing, distributing, or reselling the secrets of the purchased tricks to third parties, unless explicitly permitted.

  • This provision serves to protect the art of magic and the intellectual property rights of the creators.

Article 9 – Usage and Safety

  • 4Seasons Miracle / Magic Marketing Entertainment is not liable for any injury or damage resulting from the incorrect use of magic props and attributes.

  • The use of any products is always at the customer’s own risk.

Article 10 – Defects and Warranty

  • The customer is obliged to inspect the delivered products upon receipt if they intend to keep them as a purchase.

  • Any defects or incorrectly delivered products must be reported in writing via magic@4seasonsmiracle.com within 7 days of delivery.

  • If the complaint is justified, the webshop will provide a replacement product or a refund of the purchase price. A replacement product will only be sent to the customer after the defect or flaw has been physically inspected by the webshop.

  • The warranty does not apply if:

    • The consumer has repaired and/or modified the delivered products themselves or has had them repaired and/or modified by third parties;

    • The delivered products have been exposed to abnormal conditions, have otherwise been handled carelessly, or have been handled in violation of the instructions provided by the entrepreneur and/or on the packaging;

    • The defect is wholly or partially the result of government regulations regarding the nature or quality of the materials used.

Article 11 – Return Conditions

  • Products must be returned in their original packaging and in as-new condition.

  • Important: If a product (or its packaging) is damaged or shows signs of use beyond what is necessary to evaluate the product, 4Seasons Miracle / Magic Marketing Entertainment reserves the right to charge for depreciation or to refuse the return altogether.

  • In the case of magic tricks where the packaging is sealed to protect the secret, a return will only be accepted if the seal remains unbroken.

Article 12 – Complaints Procedure

  • Submitting a Complaint: Complaints regarding the execution of the agreement or the quality of the products must be submitted with a full and clear description via magic@4seasonsmiracle.com.

  • Response Time: Submitted complaints will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the customer will receive a confirmation of receipt within the 14-day period, along with an indication of when a more detailed response can be expected.

  • 4Seasons Miracle / Magic Marketing Entertainment will make every effort to reach a suitable solution through mutual consultation.

Article 13 – Disputes and Applicable Law

  • All agreements between 4Seasons Miracle / Magic Marketing and the customer to which these general terms and conditions apply are exclusively governed by Dutch law. This applies even if the customer resides abroad.

  • The applicability of the Vienna Sales Convention (CISG) is explicitly excluded.

Article 14 – Intellectual Property and Media Rights

  • All products, designs, drawings, writings, information, quotes, images, sketches, and models sold by 4Seasons Miracle / Magic Marketing Entertainment are protected by copyright, unless otherwise agreed upon in writing. The purchase of a product grants the customer only the right to personal and/or commercial use in live performances (such as parties, theaters, and corporate events).

  • TV and Media Rights: The customer is explicitly prohibited from performing the purchased tricks on local, national, or international television, or in commercial video productions (such as films or paid streaming services), without prior written consent from the rights holder/creator.

  • Online Media: Explaining the mechanics of the trick on platforms such as YouTube, TikTok, Instagram, or any other platform is strictly prohibited. Performing the trick is permitted, provided that the secret is not revealed.

  • In the event of a breach of these provisions, the entrepreneur (or the original creator of the trick) reserves the right to recover any damages incurred from the customer or the performer.
